What is it?

 

Alternative dispute resolution (ADR) is a form of mediation, which could enable you to save:

 

  • Money,

  • Time,

  • Energy,

  • Stress – possibly even

  • A relationship.

 

Some cases need to go to court/tribunal; but in Our adversarial system, it’s all about ‘winning’ and ‘losing’.  A successful mediation could give you a win/win outcome.

 

Who is it for?

 

Anyone involved in a disagreement over a specific issue or set of issues can potentially benefit from mediation.  It works best when everyone is:

 

  • Willing to take part,

  • Open to the process and

  • Prepared to give it a chance to help them find solutions.

 

It’s particularly useful when you want to preserve a valuable working relationship.  The oppositional nature of legal proceedings makes it difficult, if not impossible, to maintain even long-standing connections, in which you’ve invested a lot of time and attention.  Mediation is based on collaborative problem-solving, which can revive the casualties of dispute and conflict:

 

  • Communication in general,

  • Conversation in particular and

  • Trust – the glue which holds every positive relationship together.

 

Even where the dispute is a symptom of a deeper conflict, such as a personality clash, resolving the resolvable helps you manage the manageable.

 

How does it work?

 

It involves a structured conversation or series of conversations between the parties to the dispute, within a safe, confidential  environment, facilitated by an independent third party.

 

As a mediator, I’m not an advocate, or a judge.  My job is to help everybody:

 

  • Listen to each other carefully,

  • Talk to each other constructively and

  • Collaborate to find a mutually workable, lasting solution.
